1. Eligibility & Acceptance
- By using this site, you confirm that you are at least 18 years old, or that you are the parent/guardian of a minor using the site and you consent to their use.
- Your access to and use of BhelaeArts.ca constitutes your acceptance of these Terms and any additional policies referenced (including our Privacy Policy and Cancellation & Refund Policy).

- We strive to display and describe our portraits as accurately as possible; however, minor variations in tone, shading, or framing may occur due to monitor settings, handcrafted nature, and materials.
- For custom portraits, you are responsible for ensuring that:
- You have the right to use and share the reference photos you upload.
- The photos are clear and high‑quality to allow the artist to produce a good likeness.
BhelaeArts reserves the right to refuse custom requests that are inappropriate, offensive, or violate any third‑party rights.
6. Pricing & Payment
- All prices on BhelaeArts.ca are listed in Canadian Dollars (CAD) unless otherwise stated.
- We may change prices at any time, but this will not affect confirmed orders already placed and paid.
- Payments are processed via secure third‑party gateways (e.g., Stripe, PayPal, Razorpay). By submitting a payment, you authorize us and the payment processor to charge your selected method for the total amount of your order.
7. Shipping & Delivery
- We aim to ship ready‑made portraits and complete custom portraits within the estimated timeframe communicated on the product pages or during checkout.
- Actual delivery times may vary based on your location, courier performance, and external factors (e.g., customs, weather).
- Risk of loss passes to you upon delivery to the shipping address provided.
8. Cancellations, Returns & Refunds
- Our Cancellation & Refund Policy (separate page) governs how you may cancel orders, request returns, and obtain refunds.
- By placing an order, you acknowledge you have read and agree to that policy.
9. Intellectual Property
- All content on BhelaeArts.ca—including artwork images, product descriptions, logos, graphics, and overall design—is the intellectual property of BhelaeJ_Arts or its licensors.
- You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
- Purchasing artwork or a custom portrait grants you ownership of the physical piece (or delivered digital file), but not the underlying copyright, unless explicitly agreed in writing.
10. User Content & Photo References
When you upload photos or provide reference material for custom portraits:
- You grant BhelaeArts a limited, non‑exclusive license to use those images solely for:
- Creating your portrait.
- Storing them securely in relation to your order.
- We will not use your reference photos for marketing or portfolio purposes without your explicit permission.
11. Limitation of Liability
To the maximum extent permitted by law:
- BhelaeArts will not be liable for any indirect, incidental, or consequential damages arising from your use of the site or purchase of artworks.
- Our total liability in connection with any purchase is limited to the amount you paid for the specific order giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless BhelaeArts, its owners, and partners from any claims, losses, damages, liabilities, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms.
- Your use of the site.
- Any materials (such as photos) you submit that infringe third‑party rights.
